Employment Law in Canada

Employment law in Canada is a complex and often baffling field of legislation which governs the rights of employees and employers in the country. In the midst of our global economic crisis, the role of laws designed to protect workers has never been more important. The government of Canada has been actively taking steps to ensure that the rights of Canadian workers are protected and has even gone so far as to enact some very extreme and restrictive laws intended to crack down on illegal activity and protect the rights of businesses. Laws regulating employment are now more stringent than ever before, and have been since the sixties when the International Labour Organization (ILO) was formed.

Canada is not an overtly socialist country; nor does it want its workforce to have rights that resemble those of the residents of Europe. However, it has always had a strong tradition of providing social programs for its citizens, including the right to join unions and bargain collectively for the rights of Canadian workers. Because of this, employers in Canada are not legally required to give their employees the opportunity to form organizations or engage in collective bargaining. If an employer fails to follow the law, then the employee can take legal action against them.

One of the most restrictive laws regarding employment here in Canada is the Minimum Wage Act. According to this law, employees cannot be paid less than the applicable minimum wage. Despite this provision, however, employees are often subjected to harsh penalties if they should happen to break the law and claim lower wages or other benefits. Additionally, this law also severely restricts what an employer can do when an employee is terminated from their job. Laws governing severance pay and other kinds of dismissals are strictly administered, and employee cannot petition for any kind of change in their employment status in the future.

Employers in Canada are also not required to allow whistle blowing. According to one survey, only 20% of businesses in Canada have implemented whistle blowing laws. Only three laws exist which allow whistle blowing, allowing all Canadians to voice their opinions and complaint without fear of punishment. According to these laws, employers must provide proper warnings before terminating any employee for filing a complaint. Furthermore, any complaint that includes harassment must be properly investigated. The harasser has to know that there will be consequences if they continue the behaviour.

One of the most controversial laws around is the Canadian Anti-Smoking Act. This law prohibits employers from hiring anyone who smokes. On the other hand, this law also allows employers to impose certain restrictions on those who smoke. For example, smoking in the workplace is prohibited, while cigars and pipes are prohibited in some private places such as bars and restaurants. Smoking is strictly prohibited in public places such as theatres and bars.

Canada has very strict laws when it comes to its employees' rights. As a result, many people find it difficult to work and live in Canada. In fact, there are thousands of people from Canada who try to immigrate to the United States each year. However, immigrants usually face many hardships and have to pay high fees to live in the United States. Hence, the high cost of immigration can be controlled in Canada by following the employment law. If an immigrant feels that he or she has been unfairly discriminated against, they can file a complaint with the Canadian Human Rights Commission.
