Employment law in Canada is a complex and often baffling field of legislation which governs the rights of employees and employers in the country. One of the most restrictive laws regarding employment here in Canada is the Minimum Wage Act. According to this law, employees cannot be paid less than the applicable minimum wage. Despite this provision, however, employees are often subjected to harsh penalties if they should happen to break the law and claim lower wages or other benefits. Additionally, this law also severely restricts what an employer can do when an employee is terminated from their job. Laws governing severance pay and other kinds of dismissals are strictly administered, and employee cannot petition for any kind of change in their employment status in the future.
Employers in Canada are also not required to allow whistle blowing. According to one survey, only 20% of businesses in Canada have implemented whistle blowing laws. Only three laws exist which allow whistle blowing, allowing all Canadians to voice their opinions and complaint without fear of punishment. According to these laws, employers must provide proper warnings before terminating any employee for filing a complaint. Furthermore, any complaint that includes harassment must be properly investigated. The harasser has to know that there will be consequences if they continue the behaviour.
