Sexual Assault Lawyer

Sexual assault takes place when a person engages in unwanted touch or caressing of a sexual nature with another individual. This usually involves physical force, pressure, or even coercion. While sexual assault does not involve actual penetration, the crime of sexual assault actually does require that conduct took place. The term sexual assault is also used to describe an illegal sex act between a male and female, or between minors and adults.

There are two distinct types of sexual touching. In the first, a person knowingly touches another person for the purposes of sexual arousal or gratification. For example, if a man flirts with a woman and then touches her breasts, she can legally be charged with sexual battery because she was unable to say "no" to his advances. Or, if a man kisses a woman without her consent and then touches her vagina, he could be charged with sexual assault.

The second type of sexual assault takes place when a person engages in an unwanted sexual touching done without consent. These incidents often occur in the workplace, between strangers, or between some children who are in a position to consent. A sexual abuse lawyer could help victims bring claims against those who offend them. The most common victims of such crimes are women, but men also may be victimized.

One example of this type of incident is when a person fondles or touches another person who is in a public place. If it is a minor, such as a child, a custodial parent, or a person who works in a position of authority over the victim, then a civil lawsuit can be brought against the perpetrator. Some states have made it possible for victims to file civil claims for sexual abuse even when the other person did not commit a criminal offense. This is usually seen in cases involving public or private employees. For instance, a teacher who fondles children in the school or at a park cannot be charged criminally, but he or she could still be subject to a civil suit because the touching was not done with consent.

One example of another kind of incident is when a young person or child touches another in a sexual manner. Again, it may be difficult to determine whether the touching was indeed sexual. However, in many instances, if the other person is not offended or consenting, the state can prove that it was unwanted. Therefore, in one example, colarulo v. one example, the plaintiff could file a claim for invasion of privacy. This would mean that the defendant's conduct deprived him or her of the plaintiff's rights.

The third kind of incident would be when a person coerces or attempts to force another to do something they would not otherwise do. There are some circumstances where this element has been present. In instances where a man wins a woman to the ground and forces her to kiss him in order to get his attention, this may be sexual assault. The same goes for forcing a woman to do something she doesn't want such as wearing a skirt or exposing private parts would. However, the state has to prove beyond a reasonable doubt that the sexual nature of the act was determined by the victim.
